“The Laughing Man Mark and Logo” Creative Contest [Notes]

【Notice】
Kodansha Ltd. (“Kodansha”) hereby sets forth the following precautions (the “Precautions”) regarding the free download of the commemorative logo mark (the “Logo Mark”). Please download and use the Logo Mark upon agreeing to these Precautions.

 

・The copyright of the Logo Mark belongs to “Ghost in the Shell S.A.C. Production Committee” (hereinafter referred to as the “Copyright Holder”). The Logo Mark may be used only within the scope permitted by law (e.g., for private use). Any commercial use or modification of the Logo Mark, including reproduction, distribution (whether free of charge or for a fee), or sale, beyond the scope permitted by law is strictly prohibited.
・The registration of trademark using all or part of the Logo Mark is prohibited.
・The use of the Logo Mark in a manner that offends the law or public order and morals, and/or in a manner that is detrimental to the honor or reputation of Kodansha or the Copyright Holder are prohibited.
・Kodansha makes no warranty that the Logo Mark is suitable for any particular purpose, or the Logo Mark will be used continuously, or the download or use of the Logo Mark (including the Logo Mark itself) will be free from defects.
・Any dispute arising between the user and any third party in connection with this Logo Mark shall be resolved by the user at the user’s own responsibility.
・In the event that a user incurs damages as a result of using this Logo Mark, the scope of Kodansha’s liability shall be limited to direct, actual, and ordinary damages incurred during the free download period of this Logo Mark, and damages arising from special circumstances and lost profits shall be exempted, except for the damages due to Kodansha’s willful misconduct or gross negligence.
・Kodansha reserves the right to change the contents of this Notice or terminate the provision of the Logo Mark at Kodansha’s convenience.
・Kodansha may request the suspension of the use of the Logo Mark or take any other action that Kodansha deems necessary or in the event that Kodansha deems that there is a breach of any clause of this Notice.
・Even if any provision of this Notice or any part thereof is held invalid under the Consumer Contract Act or other laws and regulations, the remaining provisions of this Notice and the remaining portion of the applicable provision that are held invalid in part shall continue to be in full force and effect.
・The interpretation and application of this Notice shall be governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction in the first trial over all disputes related to this Notice.
・In case of any conflict or consistency between the Japanese version or the English version, the Japanese version shall prevail.

 

For all other logo downloads and usage, you are deemed to have agreed to the “Notes.”
